Welcome to HeadShot AI ("we," "us," or "our"). We are committed to protecting your privacy. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use our mobile application (the "App"). Please read this privacy policy carefully. If you do not agree with the terms of this privacy policy, please do not access the App.

Data privacy is at the center of the HeadShot AI app. We respect your privacy and we never ask for any unnecessary permission that violates your privacy.

2. Information We Collect

We may collect information about you in a variety of ways. The information we may collect via the App depends on the content and materials you use, and includes:

a. Image Data

• Images You Provide: To generate AI headshots, you will provide us with images of yourself ("Raw Images"). We use these Raw Images solely for the purpose of creating new, AI-generated images ("Generated Images").
• Gender Information: We may ask for information about whether the person in the images is male or female. This information is used to improve the quality and relevance of the AI image generation process. We do not use this information for any other purpose.

b. Technical and Usage Data

• Device Information: We may collect information about your mobile device, such as device model, operating system version, and unique device identifiers for troubleshooting and to ensure compatibility.
• Usage Data: To improve our App, we collect anonymous data regarding your interaction with the App, such as features used, session duration, and in-app navigation. This helps us understand user preferences and enhance the user experience.
• Crash Reports: In the event of an App crash, we may collect anonymous crash reports that include technical information about the state of the App and your device at the time of the crash. This data is crucial for identifying and fixing bugs.

c. Order Information

• Order Identifiers: When you create an order for image generation, we assign a unique identifier to that order to track its status (e.g., pending, processing, completed, failed).
• Payment Information: We utilize a third-party payment gateway for processing payments for our services or premium features. Payment processing is handled by the third-party payment processor, and we do not store your full credit card details. We may store transaction identifiers or subscription status provided by the payment processor to manage your purchases.

We explicitly do not collect personal information like your email address, phone number, or full name as part of the core image generation service, unless you voluntarily provide it for specific purposes like customer support.

3. How We Use Your Information

Having accurate information permits us to provide you with a smooth, efficient, and customized experience. Specifically, we may use information collected about you via the App to:

• Create and manage your image generation orders.
• Generate AI headshots based on the Raw Images you provide.
• Notify you when your Generated Images are ready or if there are issues with your order. This may involve background polling services and notifications as described in our app functionality.
• Improve the App's AI models and image generation quality (using gender information if provided, and image characteristics in an anonymized and aggregated way).
• Monitor and analyze usage and trends to improve your experience with the App.
• Diagnose and resolve technical problems and bugs.
• Respond to your customer service requests.
• Comply with legal obligations.
• Process payments and manage subscriptions for our services or premium features.

4. How We Share Your Information

We do not sell or rent your personal information. We may share information we have collected about you in certain situations as follows:

• Third-Party AI Service Provider: Your Raw Images are shared with our third-party AI service partner, which is responsible for the AI-driven image generation process. They use the Raw Images to create the Generated Images. We have configured their service to align with our data retention policies (see Section 5). Their use of your data is governed by their privacy policy, which we encourage you to review.
• Analytics and Crash Reporting Services: We may use third-party service providers (e.g., Firebase Analytics, Crashlytics) to collect and analyze anonymous usage data and crash reports. These providers have their own privacy policies governing their use of data.
• Payment Processors: When you make purchases, your payment information will be provided directly to our third-party payment processor (e.g., Stripe, Google Play Billing, Apple App Store). We will not store your full payment card information.
• By Law or to Protect Rights: If we believe the release of information about you is necessary to respond to legal process, to investigate or remedy potential violations of our policies, or to protect the rights, property, and safety of others, we may share your information as permitted or required by any applicable law, rule, or regulation.

5. Data Retention and Deletion

• Raw Images (Our Servers): The Raw Images you provide are temporarily stored on our secure storage service (e.g., hosted on AWS). These Raw Images are automatically deleted from our servers within 24 hours after successful submission to the AI generation service.
• Raw and Generated Images (Third-Party AI Service): Our AI service partner retains the Raw Images and the Generated Images for a period of up to 7 days. This retention allows you to download your Generated Images and helps us troubleshoot any errors that may occur during the image creation process. After 7 days, these images are automatically deleted from the AI service provider's servers, a process automated by us at HeadShot AI.
• Order History: We may retain anonymized or de-identified order information (like order IDs and status) for longer periods to allow you to view past orders across installations or for our internal analytics and service improvement. This data will not contain your Raw or Generated Images.
• Other Anonymous Data: Anonymized usage data and crash reports may be retained as long as necessary for the purposes outlined in this policy, or as required by law.

6. Data Security

We use administrative, technical, and physical security measures to help protect your information. While we have taken reasonable steps to secure the information you provide to us, please be aware that despite our efforts, no security measures are perfect or impenetrable, and no method of data transmission can be guaranteed against any interception or other type of misuse. Any information disclosed online is vulnerable to interception and misuse by unauthorized parties. Therefore, we cannot guarantee complete security if you provide personal information.

Images you provide are secured on our storage service, which may be hosted on platforms like AWS, employing industry-standard security practices.

7. Your Rights and Choices

Depending on your jurisdiction, you may have certain rights regarding your personal information. These may include the right to access, correct, or delete your data. As we minimize the collection of directly identifiable personal information, exercising these rights primarily pertains to the image data you provide.

• Accessing and Deleting Images: Generated Images are available for download for 7 days. After this period, they are deleted as per our retention policy. If you wish to request earlier deletion from our systems or the third-party AI service, please contact us, and we will make reasonable efforts to accommodate your request, subject to technical feasibility and our legal obligations.
• Notifications: Our app uses a foreground service for polling image generation status and will notify you when images are ready. You can manage notification preferences through your device settings.

8. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. We will notify you of any changes by posting the new Privacy Policy within the App and we recommend you review this Privacy Policy periodically for any changes. Changes to this Privacy Policy are effective when they are posted on this page.
